Deed storage

At Access Records Management, we offer safe and secure deed storage solutions for businesses of all sizes.

Why is deed storage important?

A deed is an important legal document that consolidates an agreement between two parties. It’s not the same as a simple ‘agreement’ – signing a deed requires a witness’ signature which makes it much harder to discredit.

Essentially, an asset owner, also known as the grantor, uses a deed to transfer their ownership or title or rights in an asset to another person or party. Deeds are commonly used as a safe way to transfer property or land ownership. They can contain details of mortgages, boundaries and rights of way, along with details of any other parties that may have an interest in the property.

The Land Registry now manages all property deeds electronically but the original paper documents are still vital for legal and commercial reasons. The length of time for which a deed will need to be stored depends upon its limitation period. The limitation period will depend on the type of deed; according to the Limitation Act of 1980, the typical duration is 12 years.

If though, a property comes up for sale that is not registered with the Land Registry, the seller will need to show 15 years’ worth of deeds proving the chain of ownership. There have been stories of lost deeds being discovered under floorboards and behind cupboards, supposedly stored for safekeeping and then long forgotten.

Secure deed storage is thus imperative to ensure that all your customer records are kept safe and are easily accessible when required. This helps avoid any complicated legal issues that could delay a sale or inheritance.

If you’re a legal firm, mortgage broker or a large company, you’re likely to have a number of original deed documents that will need to be stored securely for a long period of time.
